Debt collection agency USB Collector Kazakhstan LLP was founded in 2010 and within a short period has been recognised as a prominent participant of the corporate debt collection market in Kazakhstan.
Our company provides the following services:
- Pre-legal debt collection;
- Legal debt collection;
- Debt collection during executive proceeding and insolvency procedure.
There is no lack of law firms which can qualitatively and professionally provide all legal procedures of debt collection in Kazakhstan. However, the problem is that to collect debts applying legal procedures costs too much, is lengthy and not always efficient (e.g. when the debtor de facto but not officially is a bankrupt). Besides, such insolvent debtors quite often use legal mechanisms against theirs creditors such as assets withdrawals, willful bankruptcy, offshore schemes, etc.). Unfortunately for creditors, Kazakhstani debtors have learnt how to use legal tools to complicate debt collection for their creditors or even make it impossible.
Another reason for the current situation is rooted in the rather inefficient procedures of court decision execution. Unfortunately, it is not enough just to win litigation. You face the next problem – how to receive actual debt repayment under a received court decree. Our experience states that it is not always possible to settle this problem in all cases.
Therefore, we can state that debt collection from insolvent companies is a problem in Kazakhstan. It is worth mentioning that the assessment performed is rather rough and does not cover the largest debt share of legal entities due to banks and financial institutions.
At the same time the situation is not unpromising. We know how to collect debt which looks irretrievable from the legal point of view.
